10月16日 RDCコンゴ、採取産業透明性イニシアティブに復帰を目指す La RDC sur la voie de réintégrer le processus ITIE, selon Célestin Vunabandi

6時、快晴、27℃、45%。

昨日昼12時から断水。それが長引いて今日もまだ断水中。

台所の蛍光灯が切れたので町に買いにでた。「アラブの店」という亡くなったオーナーがレバノン人で寡婦が影響している店がある。ところがその店が閉まっていた。今日はイスラムの大祭日だった。店の前でンバングさん(僕の車を修理してくれるマペンド校のガレージ責任者)に会ったので何処で売っているか聞いた。旧「ジャカミンのマーケット」。初めに入った店にはスタータがなく、蛍光灯は中国製。2番目の店にはスタータもあったし蛍光灯はフィリップス。しかもフィリップスの方が安かった。初めの店のおっさんは「ムズング」(スワヒリ語で西欧人の意だが、要は外人)価格を僕に言ったわけだ。この店はおっさんの愛想はいいがもう行かないと決めた。

RDCコンゴは地下資源が豊富である。それは誰でも知っている。しかし、地下資源が内戦や戦争の原因にもなっているし、腐敗(汚職、贈収賄)の原因にもなっている。
そこで「採取産業透明性イニシアティブ」(EITI、フランス語ではITIE)への参加は極めて重要である。ところがRDCコンゴは今年4月から1年間候補国資格を停止された。即ちEITI加盟し遵守国になる道が遠のいたのである。これが直ちに鉱物資源の輸出規制に結びつくわけではない。しかし、国際社会、交易に不利な立場に立たされることは間違いない。
RDCコンゴの国連オカピ放送によると、RDCコンゴ政府はEITI復帰を目指して準備中であるということだ。もともとEITIから停止処分を受けたのは要はRDCコンゴが2011年から今年まで3ヵ年「透明性レポート」を全く提出しなかったからだ。不真面目としかいいようがないが、僕が心配するのは、RDCコンゴが日本を含めたEITI支援国を納得させるレポートを提出出来るのだろうかということである。

1EITIとは

 採取産業透明性イニシアティブ(Extractive Industries Transparency InitiativeEITI)とは,石油・ガス・鉱物資源等の開発にかかわるいわゆる採取産業から資源産出国政府への資金の流れの透明性を高めることを通じて,腐敗や紛争を予防し,もって成長と貧困削減に繋がる責任ある資源開発を促進するという多国間協力の枠組み。途上国政府,採取企業,市民社会の平等で開放的な参加形態が特徴。現在では39の資源産出国,我が国を含む多数の支援国,そして数多くの採取企業やNGOが参加。

 目標として,(1)資源開発は持続可能な経済成長の基盤を提供するという考えを広めること,(2)採取産業のすべての関係者をまとめ,グッドガバナンスと透明性の向上を実現するために最適の方法を模索すること,(3)採取産業における資金の流れの透明性を確保する枠組みを確立することを掲げ,資源産出国が,その保有する資源ゆえに貧困を一層深刻化させるという,いわゆる「資源の呪い」に対する有効な取組となることが期待されている。

 EITI参加国の拡大は,世界全体の資源安全保障の強化につながり,資源の殆どを輸入に依存している我が国にとって安定的な資源共有の維持・強化につながる。また,資源国における企業の公平な競争を確保するためのルール作りは,グローバル・ガバナンスを強化し,日本を含む各国の企業活動にも裨益しうる。

2.実施国

 20139月現在、16カ国がEITI基準にある加盟に関する要件を満たした「候補国(Candidate Country)」となっている。候補国となってから2年半以内にEITI認証要件をすべて満たした国が「遵守国(Compliant Country)」と認定され、現在、23カ国が「遵守国」となっている。

 我が国は20092月の第4EITI総会で支援国となるべく意思表明を行って以来,2010年には東京でEITIに焦点を当てた国際セミナー「責任ある資源開発に向けた新たな潮流(“Emerging Trend toward Responsible Natural Resource Development”)」を開催し,2011年からはEITIマルチドナー信託基金(MDTF)に対して拠出(平成23年度及び24年度に各15万ドル拠出済)するなど、積極的にその活動を支持している。

設立当初は英国国際開発省に拠点を置く国際事務局により支援・運営されていたが,2007年にノルウェー・オスロに国際事務局を設置。EITI理事会の政策決定の実施やEITI実施に向けた候補国と支援国・機関との調整等を行っている。

国際事務局のスタッフは,事務局長,地域局長,広報部長,秘書,総務部長等で構成され,事務局長は,ヨーナス・モーバーグ氏(スウェーデン人)。

2006年,候補国,支援国,市民団体,企業等の20の代表から構成される理事会が立ち上げられ,EITIの戦略的方向性,アウトリーチ,広報等について,2年に一度の閣僚級会合(総会)への勧告を行っている。理事会の議長は、クレア・ショート氏(元英国国際開発相)。

EITIマルチドナー信託基金(我が国も拠出)は,世銀が委託機関となっており,資源国がEITIを推進する際の技術協力等に使用されている。
7.経緯
鉱物取引の透明性の重要さを増している 
1)設立の経緯

  ブレア英首相(当時)が「持続可能な開発に関する世界首脳会議(WSSD)(於:ヨハネスブルク,20029月)」で提唱。

英国際開発省の主催により開催され,12項目からなるEITI原則(下記)が発表された。
The EITI Principles

We share a belief that the prudent use of natural resource wealth should be an important engine for sustainable economic growth that contributes to sustainable development and poverty reduction, but if not managed properly, can create negative economic and social impacts.
We affirm that management of natural resource wealth for the benefit of a country’s citizens is in the domain of sovereign governments to be exercised in the interests of their national development.
We recognise that the benefits of resource extraction occur as revenue streams over many years and can be highly price dependent.
We recognise that a public understanding of government revenues and expenditure over time could help public debate and inform choice of appropriate and realistic options for sustainable development.
We underline the importance of transparency by governments and companies in the extractive industries and the need to enhance public financial management and accountability.
We recognise that achievement of greater transparency must be set in the context of respect for contracts and laws.
We recognise the enhanced environment for domestic and foreign direct investment that financial transparency may bring.
We believe in the principle and practice of accountability by government to all citizens for the stewardship of revenue streams and public expenditure.
We are committed to encouraging high standards of transparency and accountability in public life, government operations and in business.
We believe that a broadly consistent and workable approach to the disclosure of payments and revenues is required, which is simple to undertake and to use.
We believe that payments’ disclosure in a given country should involve all extractive industry companies operating in that country.
In seeking solutions, we believe that all stakeholders have important and relevant contributions to make ? including governments and their agencies, extractive industry companies, service companies, multilateral organisations, financial organisations, investors, and non-governmental organisations.

EITIの実施に向け,6項目からなるEITI基準(下記)が合意された。また,EITIを進めるための手引書(EITI Source book)が発行された。
The EITI Criteria

Regular publication of all material oil, gas and mining payments by companies to governments (“payments”) and all material revenues received by governments from oil, gas and mining companies (“revenues”) to a wide audience in a publicly accessible, comprehensive and comprehensible manner.
Where such audits do not already exist, payments and revenues are the subject of a credible, independent audit, applying international auditing standards.
Payments and revenues are reconciled by a credible, independent administrator, applying international auditing standards and with publication of the administrator’s opinion regarding that reconciliation including discrepancies, should any be identified.
This approach is extended to all companies including state-owned enterprises.
Civil society is actively engaged as a participant in the design, monitoring and evaluation of this process and contributes towards public debate.
A public, financially sustainable work plan for all the above is developed by the host government, with assistance from the international financial institutions where required, including measurable targets, a timetable for implementation, and an assessment of potential capacity constraints.

3EITI閣僚級会合(200610月,於:オスロ)
 ナイジェリア,アゼルバイジャンより実施報告書を公表。また,国際諮問グループより提出されたEITI原則の重要性,企業のEITI実施評価方法,理事会の設置等についての勧告が採択された。今後2年ごとに総会を開催することを決定。さらに,マダガスカル,イエメン,コートジボアール及びリベリアの4ヵ国から参加表明。

4EITI閣僚級会合(20092月,於:ドーハ)
 我が国代表(外務省経済安全保障課長)がEITI総会に初めて正式に出席し,支援国としての意思表明を行った。

5EITI閣僚級会合(20113月,於:パリ)
 我が国代表(在仏大公使)がEITI総会で,EITIマルチドナー信託基金に対して,15USドルの財政的支援の実施を予定している旨言及した(201112月拠出済)。

6EITI閣僚級会合(20135月,於:シドニー)
 理事会での承認を経て、EITI新基準が発表された。EITI原則に変更はないが、EITI認証要件は以下の7項目になり、分野に関するより多くの詳細情報や定性的評価も取り入れることになった。

The EITI requires:

Effective oversight by the multi-stakeholder group.
Timely publication of EITI Reports.
EITI Reports that include contextual information about the extractive industries.
The production of comprehensive EITI Reports that include full government disclosure of extractive industry revenues, and disclosure of all material payments to government by oil, gas and mining companies.
A credible assurance process applying international standards.
EITI Reports that are comprehensible, actively promoted, publicly accessible, and contribute to public debate.
That the multi-stakeholder group takes steps to act on lessons learned and review the outcomes and impact of EITI implementation.

Le président du comité exécutif de l’ITIE RDC, Célestin Vunabandi a déclaré lundi 14 octobre que la RDC est sur la voie de réintégrer le processus de l’Initiative pour la transparence des industries extractives (ITIE). Le pays est suspendu de cette organisation pour un an depuis avril dernier, pour n’avoir fourni aucun rapport sur la transparence dans l’industrie extractive en trois ans, de 2011 à 2013. Selon le site de l’ITIE Internationale, le tout premier rapport publié en mars 2010, portait sur l’année 2007. Un autre rapport a été publié en mars 2012 et portait sur la période 2008-2009. ITIE RDC a divulgué en janvier dernier un autre rapport portant sur les données de 2010.
«La RDC pourra être déclarée conforme car une étude de cadrage est déjà adoptée. Le cabinet KPMG fait la conciliation des comptes. Tout se passe bien et nous pensons que d’ici décembre prochain, nous aurons bouclé le rapport 2011», a assuré Célestin Vunabandi.
Au cours de cette réunion, la RDC a été informée sur la norme mondiale que l’ITIE a établie pour les revenus issus de l’exploitation des ressources naturelles. Cette norme garantie une plus grande transparence des ressources pétrolières, gazières et minérales des pays, d’après le président du comité exécutif de l’ITIE RDC.
Après la RDC, la délégation de l’ITIE se rendra à Abidjan, en Côte d’Ivoire, où elle organisera des conférences pour renforcer les pays africains sur les contenus de la nouvelle norme ITIE.
En avril dernier, la RDC avait été suspendue pour un an de l’ITIE qui, sur son site Internet, avait dit relever «un défaut d’exhaustivité» et elle avait jugé insuffisante la «qualité des données» dans les rapports transmis sur les paiements issus de l’exploitation des ressources naturelles.
Selon la méthodologie décrite par l’ITIE sur son site internet, les entreprises minières publient les paiements qu’elles effectuent et les gouvernements font connaître les revenus qu’ils reçoivent dans un rapport. Ce processus est censé permettre une vérification indépendante des taxes et impôts perçus afin d’assurer la transparence des paiements issus de l’exploitation des ressources naturelles.
